OFFICIAL STATEMENT AND NOTICE REGARDING ALLEGED DEFAMATORY STATEMENTS AGAINST BUENA PERSONAL CARE PRODUCTS TRADING

This official statement is issued by BUENA Personal Care Products Trading (“the Company”) in order to formally address recent comments made by a Facebook user identified as “Maeheart Care's,” which were posted on the Company’s official social media platform. The Company finds it necessary to place this matter on record in view of the potential harm such statements may cause to its reputation, business integrity, and public trust.

To provide context, the Company confirms that it has a valid and subsisting agreement with Ms. Carrie Laine Abad, wherein ten percent (10%) of the total sales from designated products is allocated as support for her advocacy aimed at assisting stranded foreign nationals in the Philippines who are seeking to return to their respective countries.

Pursuant to this agreement, the Company exercises proper internal controls over all allocated funds, and any release or disbursement is strictly subject to the submission of appropriate documentation, verification of intended use, and compliance with agreed accountability measures. This process is implemented to ensure transparency, proper governance, and the lawful use of funds in accordance with the agreed purpose of the arrangement between both parties.

The Company further confirms that certain content relating to Ms. Abad’s advocacy was posted with her express permission and consent, solely for the purpose of supporting awareness of her charitable efforts.

It has come to the attention of the Company that a Facebook user under the name “Maeheart Care's” published comments and statements on the Company’s official page which, upon review, appear to contain assertions that may be construed as false, misleading, and damaging to the reputation of the Company. These statements were made publicly and were accessible to third parties, thereby exposing the Company to potential reputational harm in the digital space.

The Company has duly documented and preserved all relevant evidence, including screenshots and records of the original comments, for proper reference and potential legal proceedings. It is likewise noted that certain comments were subsequently edited or deleted by Maeheart Care's; however, it is a well-settled principle that liability arising from online publication is not negated by subsequent modification or removal of content, especially where such publication has already been made public and accessed by third parties.

The Company respectfully emphasizes that under Republic Act No. 10175, otherwise known as the Cybercrime Prevention Act of 2012, cyberlibel is committed when a defamatory imputation is published through a computer system or any similar means, and such imputation tends to injure the reputation, character, or credibility of a person or juridical entity. Philippine jurisprudence recognizes that business entities, as juridical persons, are entitled to protection of their reputation against unlawful, malicious, or unfounded public statements that may cause damage to their commercial standing. Accordingly, any online publication that attributes false or injurious statements to a business entity may give rise to civil, criminal, and other appropriate legal remedies.

IN LIGHT OF THE FOREGOING, THE COMPANY HEREBY FORMALLY REQUIRES THE INDIVIDUAL KNOWN AS “MAEHEART CARE’S” TO ISSUE A CLEAR, UNEQUIVOCAL, AND PUBLICLY VISIBLE RETRACTION AND APOLOGY ADDRESSING THE STATEMENTS MADE AGAINST BUENA PERSONAL CARE PRODUCTS TRADING. SUCH RETRACTION AND APOLOGY MUST BE POSTED ON THE SAME “MAEHEART CARE’S” ACCOUNT THAT WAS USED IN PUBLISHING THE SUBJECT COMMENTS IN ORDER TO MITIGATE THE EFFECTS OF THE PUBLICATION AND TO PROPERLY INFORM THE SAME AUDIENCE THAT MAY HAVE BEEN EXPOSED TO THE ORIGINAL CONTENT. THE COMPANY HEREBY REQUIRES STRICT COMPLIANCE WITH THIS DEMAND WITHIN TWENTY-FOUR (24) HOURS FROM THE ISSUANCE OF THIS NOTICE.

Should there be failure or refusal to comply within the prescribed period, the Company will be constrained to consider and pursue all available legal remedies under Philippine law without further notice. This includes, but is not limited to, the filing of appropriate civil and criminal actions for damages and cyberlibel under the Cybercrime Prevention Act of 2012, as well as any other actions that may be warranted under applicable laws and regulations to protect the Company’s rights and interests.

This statement is issued in good faith, without prejudice to any further rights, claims, or causes of action that BUENA Personal Care Products Trading may have under law, equity, or contract. We are not concerned with determining who between the two parties assisted first or who ultimately completed the mission involving that particular foreign individual. That is not within our scope, nor is it something we are involved in.

To clarify our side:

1.The photo that was used and referenced was originally publicly posted by Carrie herself. This indicates that at the time the photo was taken and shared, she was the one who rendered assistance. We simply relied on what was already publicly available and attributable to her own post.

2. Before using the photo, we properly sought permission from Carrie since the image belongs to her. She expressly gave her approval for its use, which is why we proceeded in good faith and in accordance with proper consent.

This is the full extent of our involvement in that matter. Beyond these facts, we are no longer part of, nor do we have any participation in, any personal issue or conflict between the individuals involved.

Our position remains straightforward: when help is given, it is given freely. There is no need to publicly assign credit, compare efforts, or announce who did more or who did less. Acts of assistance should not be turned into public disputes or used to create unnecessary narratives.

However, it is important to emphasize that the statements made against us are entirely separate from their personal disagreement. Whatever internal conflict exists between them does not justify or excuse the public remarks that were made involving our name.

Those statements have caused reputational harm to our organization, despite us having no involvement in their personal issues.

For clarity, we are only addressing what directly concerns us. Any other matters between the parties should be resolved between them, as we remain completely outside of that conflict.
