AN OPEN LETTER TO THE BOSTON YOGA COMMUNITY AND BEYOND
We are all former staff and faculty of Down Under School of Yoga, and we have an important message to share. We stand united in opposition of the Down Under School of Yoga contract, which includes non-compete, non-solicitation, and non-disparagement requirements for all teachers, managers, bodyworkers and desk staff. The teaching contract and the non-compete clause restricts teaching yoga at other nearby yoga studios, fitness centers and private homes – in some cases it spans a radius of up to 5 miles. Furthermore, this non-compete clause also restricts the ability to teach yoga within that radius for an additional 1 year following departure from Down Under. The teaching contract includes the non-compete clause even though it is our understanding that Massachusetts law prohibits the use of non-competition agreements with employees such as yoga teachers who are nonexempt under the Fair Labor Standards Act.
For many of us, this meant that the act of leaving Down Under threatened our very livelihood as yoga teachers because of the fear of non-compete restrictions. This has caused significant pain and heartache for dozens of former Down Under yoga teachers, many who were forced to stop teaching yoga altogether after leaving Down Under to make ends meet.
The non-solicitation clause in the contract is written so that any current or former Down Under student is effectively off limits for any form of contact involving yoga classes, workshops, trainings, retreats, etc. that are not affiliated with Down Under, even if we introduced them to Down Under. This causes consternation and fear of potential consequences among faculty when considering routine yoga teaching activities such as planning a retreat or teaching a workshop outside of the non-compete radius. Furthermore, the non-disparagement language included in this clause has been used as a means to prevent current and former employees from discussing the realities of these contracts as well as other aspects of our collective working experiences at Down Under.
The contract has set a dangerous precedent and established the foundation for a one-sided relationship based on constant fear of being subjected to legal action. With the realities of trying to make a living wage teaching yoga, the thought of having to spend large sums on legal fees can be frightening and overwhelming, and this framework has enabled the studio to effectively control its staff.
Due to fears about the non-compete portion of the contract, many of us who are yoga teachers were initially forced to choose between working at Down Under or other smaller independent yoga studios with fewer resources, culminating in a climate where it has become perfectly acceptable for Down Under to aggressively recruit teachers from “competitive” studios, while simultaneously threatening those same studio owners with litigation should they attempt to hire current or former Down Under teachers. This framework has essentially given Down Under a green light to “poach” teachers in any capacity throughout the Boston area free of any repercussions, threatening the livelihood of other smaller local studios.
Once all of us in this group built up the courage to establish a dialogue and we began openly sharing our stories with each other, we were all surprised and touched by the common threads of our collective working experience at Down Under. We have been silent for too long and we all share the responsibility to condemn this behavior, which is particularly reprehensible and unwelcome in our local yoga community where a philosophy of compassion and mutual respect should govern our behavior.
Our call to action is for Down Under Yoga to remove the onerous requirements from its contracts going forward and to provide all faculty and staff the opportunity to reexamine and renegotiate the terms of their existing contracts. We expect Down Under Yoga to live up to their promises of being an ethical leader in the yoga community.

reimagined had me taking a leisurely autumn ride with my parents. Proud to wear my outfit! Kirbys Dream Team raise money for Kirby's Fund for Innovative Pancreatic Neuroendocrine Carcinoma Research. Kirby had been coming to my yoga classes for over a year (prior to the COVID-19 Crisis). She was always such a bright source of light and inspiration. I am so glad that she found yoga as a source of comfort on her path to wellness but its truly Kirby who taught me so much about resilence and strength.
