Brazilian President Luiz Inácio Lula da Silva signed two decrees this week that would bring major changes to concerts in the country, mandating free water at large-scale events and requiring greater transparency in the ticketing industry.

Both pieces of legislation stem from Taylor Swift’s The Eras Tour, which visited Brazil in November 2023. At one of the shows in Rio de Janeiro, 23-year-old Ana Clara Benevides died after suffering cardiorespiratory arrest due to heat stroke, according to O Globo. Starting next month, all events with more than 1,000 attendees must provide drinking fountains or distribute water free of charge, and allow attendees to bring their own personal bottles. These rules apply even if water or other beverages are sold on-site. Since Benevides’ death, an emergency decree has guaranteed access to water at events held in high temperatures.

The other bill takes aim at both the primary and secondary ticketing markets. When Swift came to Rio in 2023, scalpers sold tickets for as high as R$12,000 ($2,342 USD) when the face price was no more than R$1,000 ($195 USD). Many of Brazil’s new regulations already exist in the United States, such as requiring primary ticketing companies to adopt technologies that combat bot sales and making secondary sellers disclose the ticket’s original price and any additional fees. The new law also dictates that it will be free to electronically transfer ownership of a ticket.

“If it weren’t for you, we wouldn’t be making this decree,” President Lula said to the representatives from fan groups for Taylor Swift, BTS, Harry Styles, Lady Gaga, and others, who campaigned for the changes. “In other words, at some point you decided to speak up. At some point you decided to draw someone’s attention to the fact that it wasn’t fair for you to make a sacrifice.”

A more stringent bill that would criminalize selling tickets for more than the original price and incarcerate scalpers, nicknamed the “Taylor Swift Law,” passed the House in 2024 but is still awaiting Senate review. Rather than penalizing individual scalpers, the new decree signed this week provides obligations for companies and ticketing platforms. The decrees will go into effect 30 days after publication.

In the United States, there is currently no federal law requiring businesses or large-scale concerts to provide free water to patrons, although states like New York and Illinois have their own laws requiring access to free water. Many concert venues nonetheless take it upon themselves to provide water fountains and hydration stations.
