1. Drugs & Cosmetics Act, 1940 & Rules, 1945

This is the main law governing dispensing.

🔹 Rule 65(2) – Drugs & Cosmetics Rules, 1945

This is the most important rule.

📌 Rule 65(2):

> Medicines (Schedule H, H1, X) must be dispensed only under the personal supervision of a Registered Pharmacist.

Meaning:

Only a qualified registered pharmacist can dispense.

A non-pharmacist cannot dispense.

Pharmacist must be physically present.

🔹 Rule 65(10)

> Prescription drugs must be supplied only by or under the supervision of a registered pharmacist, and proper records must be maintained.

🔹 Licensing Requirement (Rule 64 & 65)

A medical shop must have a registered pharmacist to get or renew its drug licence.

If pharmacist is absent, dispensing is illegal.

✅ 2. Section 42 – Pharmacy Act, 1948

This Act defines the practice of pharmacy.

📌 Section 42(1):

> No person other than a Registered Pharmacist shall practice pharmacy.

Dispensing = Practice of Pharmacy, so only registered pharmacists are legally allowed.

Penalty (Section 42(2))

Unauthorized dispensing can lead to:

Imprisonment up to 6 months, or

Fine, or both.

✅ 3. Indian Penal Code (IPC) Sections Applicable

Dispensing by a non-pharmacist can also lead to criminal charges:

🔹 IPC Section 420 – Cheating

If medicines are dispensed without qualification.

🔹 IPC Section 468 – Forgery for cheating

If fake billing, fake signatures, or false pharmacist name is used.

🔹 IPC Section 269 & 270 – Negligent / malignant act spreading infection

If improper dispensing harms public health.

🔹 IPC Section 274 – Adulteration of drugs

🔹 IPC Section 275 – Sale of adulterated drugs

🔹 IPC Section 276 – Sale of drugs as different drugs

All these may apply in malpractice.

✅ 4. Drug Inspector Powers (D&C Act Section 22)

A drug inspector can:

Seize stock

Cancel/ suspend license

File criminal case if medicines are sold without a pharmacist.
