In Washington state, you can be held criminally liable for "supporting" an illegal business under the law of accomplice liability. A person becomes an accomplice by knowingly helping or encouraging another person or business to commit a crime.
The liability for an accomplice is the same as for the person who directly commits the crime.
The legal definition of complicity
According to Revised Code of Washington (RCW) 9A.08.020, an individual is legally accountable for another's criminal conduct if they are an accomplice. A person is an accomplice in the commission of a crime if, with knowledge that it will "promote or facilitate" the commission of the crime, they do either of the following:
Solicits, commands, encourages, or requests another person to commit the crime.
Aids or agrees to aid another person in planning or committing the crime.
How complicity applies to businesses
The law holds a person criminally liable for illegal conduct they perform "in the name of or on behalf of an entity" to the same extent as if they acted on their own behalf.
This means if you provide assistance or services to a business with the knowledge that it will help them commit a crime, you could face criminal charges. While "supporting an illegal business" is not a crime in itself, the law applies to specific, illegal activities, such as:
Aiding tax evasion: Knowingly helping a business to illegally conceal revenue or avoid paying taxes can result in penalties.
Facilitating fraudulent schemes: Providing assistance to a pyramid scheme, for example, is a violation of the state's Anti-pyramid Promotional Schemes Act.
Corruptly influencing an agent: It is a gross misdemeanor to give a reward to a company agent to influence their business actions unlawfully.
Ignoring a duty to act: If an agent of an entity has a duty to act but fails to perform a required act, resulting in an offense, they can be criminally liable.
How to protect yourself
Due to the serious nature of accomplice liability, which can result in the same felony charges and prison time as the primary offender, it is crucial to seek legal advice if you believe you have supported a business's illegal activities. Defenses may be available, but proving your lack of knowledge or intent requires the help of a skilled attorney.
