PROSECUTION RESTS CASE; SHOWS VIDEO/AUDIO OF ATHENA IN HER FINAL MOMENTS:
I will be honest, this was a hard day for many. I know we are all exhausted by the heavy nature of this trial, but you have been placing your trust in me and CBS News Texas to keep you updated on this case. Today was tough, but it was also crucial.
WARNING: This includes graphic descriptions. The judge did not allow cameras in the courtroom. This is all based on first-hand notes from our reporters who were inside and watched the video.
The prosecution finally unveiled the video from the day delivery driver Tanner Horner kidnapped 7-year-old Athena Strand from her home.
Horner is seen covering the front-view camera of his FedEx truck.
He can be seen clearing space in the back of the truck, tossing boxes toward the front.
He then drives to Athena’s home, pulls over, grabs a package, and exits the truck.
He returns with Athena trailing behind him.
He opens the back of the truck and shows it to her.
Eventually, he appears to pick her up and carry her inside. At that point, several people in the courtroom walked out, unable to keep watching.
Athena asks several times, “Where are we going?”
At one point, she also asks if he is a kidnapper.
Horner then covers the interior cabin camera with what appears to be a sticky note.
After that, there is only audio.
Horner asks:
“How old are you?”
“Where do you go to school?”
“You’re really pretty. You know that?”
Eventually, he pulls over.
Athena asks, “What are you doing?” several times.
She can be heard whimpering.
Athena says, “My mom said you can’t do that.”
Horner responds, “No.”
Athena says, “I want mama.”
She can be heard crying quietly.
The truck starts moving again. At least one juror is wiping away tears. People in the gallery are as well.
The truck stops again.
Athena screams.
The truck starts again.
Athena says something.
Horner responds, “If you don’t shut up, it’ll hurt worse.”
He repeatedly tells her to “shut up.”
Eventually, Horner is driving again and removes the sticky note from the camera. We can once again see inside the truck.
Athena is not there.
Horner is seen smoking a cigarette. He stops at a gas station, grabs a roll of paper towels, then goes to the back of the truck and cleans the floor.
The state has now rested its case. The defense has three days to prepare its rebuttal.
I did not share these details lightly. I am sorry if this is hard to read. But for those who have been following this case closely and praying for this family, this day and these details matter. They are part of what the jury now has to weigh in the days ahead ... whether to sentence Horner to death or to life in prison.
