I received a letter claiming I violated the speeding law in Manhattan, New York, on 03/20/2024.
As per the instructions, I am writing to plead “NOT GUILTY” to this charge. Although this option is said to result in this matter going to court, I suggest that the charges simply be dropped.
This suggestion comes from respect for taxpayers, and I request that their hard-earned money not be wasted in such proceedings. As there is no evidence of my involvement with this alleged ‘crime’ and the fact that I am not granted my 6th amendment right to face my ‘accuser’ (a camera); I see no way the government could prove my guilt beyond a reasonable doubt. I also see no legal requirement to implicate someone else in the process, as it is the government’s responsibility to prove a person’s guilt. It is also my 5th Amendment right to remain silent on the matter.
If the government decides to move forward in this matter, I would request copies of any evidence the prosecution may have of my involvement in the “offense”; as well as, all maintenance records for the camera(s) involved. Please provide all evidence as such:
(1) provide proof of your claim in the form of a ticket, affidavit, or citation signed by an officer of the NEW YORK County Police Department or any other Law Enforcement Highway Officer whose duty it is to enforce traffic laws in the State of New York; and
(2) provide evidentiary proof via sworn testimony that the driver, YOUR NAME HERE IN ALL CAPS, was behind the wheel operating the motor vehicle; and
(3) that your camera lights have been calibrated for accuracy and that you produce a Certificate of Authority by a third party like the State of New York Department of Weights and Measures, to prove with sworn testimony that your cameras are not fraudulently issuing tickets to the people of the state of New York; and
(4) that a chain of title of the custody of access to the programming, controlling, and possession of the equipment, the machines, and the computers running these cameras, has not been intercepted by any party committing foul play, a fraudulent or illegal scheme to issue false-positive tickets to law-abiding drivers, or to otherwise defraud the people of the State of New York; and that your company “NYC DEPARTMENT OF FINANCE, SCHOOL ZONE CAMERA UNIT” is part of the STATE OF NEW YORK and has the authority by the Constitution of the STATE OF NEW YORK to issue said tickets.
