Federal Records

Federal records can contain any information, documents, or files that gets in the hands of the federal government. It is federal law and routine to keep these files on record for a scheduled amount of time before disposing them -- doing so before schedule could be a violation of the Freedom of Information Act.

If you’ve ever been involved in a federal case, whether it be a civil lawsuit, a criminal case, or filing for bankruptcy, this information can be stored in federal records. This can be displayed in a background check or even in your public record.

There could be many reasons why you would want to search for federal records. Maybe you want to see if there are any federal cases that you’re involved in or maybe you want to dig up some of your family history. Since federal records could contain criminal cases at the federal level, you might want to dig up some information about your friends or social media encounters.

Whatever your reasoning, federal records are meant to be public -- with a few exceptions -- and allow for transparency at the federal level. A lot of this can be credited to the Freedom of Information Act.

Freedom of Information Act

The Freedom of Information Act was made effective on July 5, 1967. It was designed to ensure the federal government properly filed, kept, released, and eventually disposed of any and all documents they control. For those that wonder why we are able to view so many documents or emails from the Supreme Court, Congress, and White House, a lot of it is a result of the Freedom of Information Act.

Although the Freedom of Information Act allows our government to run with transparency, it also allows the public to operate with transparency among itself. This means that anyone involved in a federal case of any sort can have that information available for everyone to see.

Types of Federal Records

Federal records can contain a wide range of information, not only limited to government officials. The federal courts are constantly busy dealing with things happening around the country, so there are plenty of documents to be filed.

In cryptography and computer security, a man-in-the-middle, monster-in-the-middle,[1][2] machine-in-the-middle, monkey-in-the-middle,[3] meddler-in-the-middle,[4] manipulator-in-the-middle[5][6] (MITM), person-in-the-middle[7] (PITM) or adversary-in-the-middle[8] (AiTM) attack is a cyberattack where the attacker secretly relays and possibly alters the communications between two parties who believe that they are directly communicating with each other, as the attacker has inserted themselves between the two parties.[9] One example of a MITM attack is active eavesdropping, in which the attacker makes independent connections with the victims and relays messages between them to make them believe they are talking directly to each other over a private connection, when in fact the entire conversation is controlled by the attacker.[10] The attacker must be able to intercept all relevant messages passing between the two victims and inject new ones. This is straightforward in many circumstances; for example, an attacker within the reception range of an unencrypted Wi-Fi access point could insert themselves as a man-in-the-middle.[11][12][13] As it aims to circumvent mutual authentication, a MITM attack can succeed only when the attacker impersonates each endpoint sufficiently well to satisfy their expectations. Most cryptographic protocols include some form of endpoint authentication specifically to prevent MITM attacks. For example, TLS can authenticate one or both parties using a mutually trusted certificate authority.[14][12]

Copyright Repeat Infringer Policy

In order to protect the rights of copyright holders, Google implements a copyright repeat infringer policy under which we may take action against users who repeatedly misuse our services by violating Google’s copyright standards and local laws.

Our repeat infringer policy is implemented seriously to take timely actions upon notice against users who repeatedly misuse our services in this way. 

Who is a repeat infringer and how is it determined?

Under Google’s policy, a ‘repeat infringer’ is any user who consistently fails to adhere to Google's repeat infringer policy. This may be due to multiple successful copyright complaints against them within a stipulated period of time and could result in the repeat infringer’s account being restricted.
 

If we receive a valid copyright complaint identifying infringing content published on any of Google’s products, the content may be removed. If this happens too often, we will take action against the account and the user will be notified. Once we take action against an account, the user may be prevented or restricted from accessing Google’s services until a successful appeal is received and processed. 

 

What constitutes as too many violations and what will result in account action varies by product. Our decision to restrict an account will be based on all available evidence, including such considerations as the copyright holder’s allegations, whether the content was removed expeditiously, and any successful appeals against individual infringements or against the account restriction.

Are there any appeal options?

We are committed to making our platforms accessible to users. Hence, we take retractions and appeals into consideration when implementing our repeat infringer policy.

Retractions 

A retraction is a request that a complainant submits to Google to withdraw the copyright complaint they originally made. Google will assess retractions and restore the content previously removed where appropriate. We have shined a light on s*xual harassment in our workplaces, revealing the shocking frequency and severity of such disturbing and illegal conduct. But harassment goes beyond that of a s*xual nature. And during the public health emergency when many are working from home, cyberbullying has also been on the radar.

“Workplace bullying” is the “repetitive and systematic engagement of interpersonally abusive behaviors” that harm both the targeted person and the entire organization, according to an article by two physicians. They explain that bullying can have “[e]motional/psychological consequences” like sleep disturbance, fatigue, depression, anxiety, distress and in the worst cases, su***de. Harassment can also cause physical problems like neck pain and other pain, fibromyalgia, musculoskeletal problems and cardiovascular issues.

Unlawful discrimination includes harassment

Sexual harassment is a type of s*x discrimination. Many do not know that any protected characteristic for purposes of illegal workplace discrimination is also protected from harassment. For example, employers may not discriminate based on gender, religion, disability, age, race, national origin and other protected characteristics – nor may an employee be harassed for these reasons.

Harassment based on a protected characteristic has the same legal remedies as discrimination. Complaints can be made to state and federal agencies and often lawsuits in state or federal court are available.

What if the bullying is not based on a protected trait?

If the harassment was not based on a protected characteristic and has caused a mental injury such as PTSD or anxiety, the victim may still have legal remedies. (a)As used in this chapter—

(1)

The term “administrator” means the official designated by the Secretary of State pursuant to section 1104(b) of this title.

(2)

The term “advocates” includes, but is not limited to, advises, recommends, furthers by overt act, and admits belief in.

(3)

The term “alien” means any person not a citizen or national of the United States.

(4)

The term “application for admission” has reference to the application for admission into the United States and not to the application for the issuance of an immigrant or nonimmigrant visa.

(5)

The term “Attorney General” means the Attorney General of the United States.

(6)

The term “border crossing identification card” means a document of identity bearing that designation issued to an alien who is lawfully admitted for permanent residence, or to an alien who is a resident in foreign contiguous territory, by a consular officer or an immigration officer for the purpose of crossing over the borders between the United States and foreign contiguous territory in accordance with such conditions for its issuance and use as may be prescribed by regulations. Such regulations shall provide that (A) each such document include a biometric identifier (such as the fingerprint or handprint of the alien) that is machine readable and (B) an alien presenting a border crossing identification card is not permitted to cross over the border into the United States unless the biometric identifier contained on the card matches the appropriate biometric characteristic of the alien.
