"Form 5102" is a scam, not a real government form — if you or Carole by Design received one, don't respond or pay.
What's happening:
It's a fake letter titled "Mandatory Beneficial Ownership Reporting," often from a phony "Annual Records Service," demanding a filing fee (usually $119–$149) from businesses, referencing the Corporate Transparency Act, and designed to look official with government-style formatting. FinCEN has explicitly stated it does not have a "Form 4022" or a "Form 5102" — any correspondence referencing these forms is fraudulent, and there is no fee to file BOI directly with FinCEN. (FinCEN)
Important update on actual BOI requirements: On March 21, 2025, FinCEN issued an interim final rule removing the requirement for U.S. companies and U.S. persons to report beneficial ownership information to FinCEN under the Corporate Transparency Act. (FinCEN)
So as of now, BOI reporting isn't even a live requirement for most domestic businesses like an LLC — meaning the scam letter has even less legitimacy than before.
If you got this letter:
Don't pay it or send any business info
Discard the letter or delete the email (Wvco)
